New Continuing Education Course for Real Estate Licensees: “Unclear Title – the Law of Encumbrances”

The New Jersey Real Estate Commission has approved a new Continuing Education Course, “Unclear Title – the Law of Encumbrances,” written and presented by South Jersey attorney Robert J. Incollingo. The Course Identification/Reference Number is: C20160387.

“Unclear Title – the Law of Encumbrances,” 2 credits, will present an overview of the ways in which real property can be encumbered by encroachments, deed restrictions, and liens and claims of every type. Sometimes exotic and sometimes archaic in form, these common roadblocks to the smooth transfer of title must be recognized and understood when encountered, and resolved or figured into the terms of sale. The material will be delivered with reference to the common law of real property, as well as to New Jersey case, statutory and regulatory law, with special attention paid to relevant clauses in commonly used agreements of sale. Upon successful completion of the course, the student should be better able to assist the consumer client to understand and manage impediments to clear title in the acquisition and transfer of residential real estate.
